INFORM Consumer Act
The INFORM Consumers Act takes effect on June 27, 2023. This law places new requirements on both ShopSimon™ and its partners to disclose information about the sellers of products listed for sale on Shop. Simon.com. These requirements must be met in order to continue to sell on Shop. Simon.com. Failure to do so can result in payments being delayed and products being delisted from the site.
Under the new law, retailers are required to do the following:
- Provide, and ShopSimon™ must collect, verify, and disclose, certain specific information about their business.
- Keep this information current and notify ShopSimon™ when their information changes, at which point ShopSimon™ must verify the new information.
- On an annual basis, certify that their information is current.
Who Is Covered Under the INFORM Act?
The law applies to sellers on ShopSimon™ who, in any continuous 12-month period during the previous 24 months, have sold 200 or more new or unused consumer products and have had $5,000 or more in gross revenues.
What Information Must Be Provided If Required By the INFORM Act?
ShopSimon™ must collect and verify the following for a Retailer:
- Business address
- Bank account information
- Working email address
- Working phone number
- Tax identification number
This information must be either in the business name of the Retailer or for an individual legally authorized to act on the Retailer’s behalf.
What Information Is Shared With Customers?
To comply with the new requirements under the INFORM Consumers Act, we will list the Ships and Sold By information for every product sold on ShopSimon™.
We will provide the required Retailer physical address information with ShopSimon™'s contact information to customers via each Retailer's storefront on ShopSimon™. This information will be the City and State of the Returns Location. Any contacts from customers will triaged by ShopSimon™ and will be escalated to your team as necessary.

What Happens If I Do Not Provide The Required Information?
If we contact you by email with a verification request, we will share specific instructions and a timeline for response. If you do not respond within the timelines requested, we may be required by the law to withhold your payments or deactivate your selling account until you provide the information that is necessary to successfully complete verification.
